Terms and Conditions

  1. Scope

For all deliveries of Turnvergnügen Kai Liebelt, Eschenstr. 2, 12161 Berlin (hereinafter referred to as Turnvergnügen) via this online store to consumers, these General Terms and Conditions (GTC) apply. Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither their commercial nor their independent professional activity can be attributed.

2. Conclusion of a purchase contract

A. The presentation of the products in the Turnvergnügen online store does not constitute a legally binding offer, but only an invitation to submit an offer (“offeratio ad offerendum”).

B. By clicking the button "Buy" you place a binding order for the goods listed on the order page. A contract of sale is concluded when Turnvergnügen accepts your order by sending an order confirmation by e-mail immediately after your order.

3. Right of withdrawal for consumers

A. Consumers have a right of withdrawal (cancellation) according to the conditions below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. If you make use of your right of withdrawal as a consumer, you have to bear the regular costs of the return. In addition, the regulations apply to the right of withdrawal, which are reproduced in detail in the following cancellation policy:

Cancellation Policy

You have the right to revoke this contract within fourteen days without giving any reason.The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Turnvergnügen Kai Liebelt, Eschenstr. 2, 12161 Berlin, info@turnvergnuegen.com, +49 170 9057491) by means of a clear statement (e. g. a letter sent by mail or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

4. Prices and Shipping Costs

As a small business in the sense of § 19 para 1 UStG (Germany) sales tax is not calculated and is not included in the price. Costs for any further taxes as well as customs duties in countries outside the EU are borne by the customer. In addition to the stated prices, we charge shipping costs for delivery, the amount of which can be found on the product page and which will be clearly communicated to you again in the shopping cart system and on the order page.

5. Payment and delivery

Payments are due in advance. The delivery of the goods will be made after receipt of payment. The cost of shipping will be displayed to the customer before submitting his order.

6. Choice of laws

This contract is governed by German law with the exception of the provisions of international private law.

7. Dispute Resolution

The EU Commission has created an Internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
